Our commitment to your privacy

Your privacy is important to us. We respect your right to privacy and your right to view and update the personal information which we hold about you. We are committed to protecting your privacy when you visit our website, use our services or deal with us in any other way.

We will only collect your personal information in accordance with the Privacy Act 2020 and this Privacy Policy.  As an existing or prospective client or as a website user, you are consenting to this Privacy Policy.

If you do not want us to collect or use your information as outlined in this Privacy Policy, you should please stop using our website or services.

Collecting information from you

SHARE provides financial advice in relation to insurance, investments and mortgages.  In order to offer you financial advice we collect personal information from you, including information about your:

  • Name
  • Contact information (such as address, telephone number and email)
  • Date of birth
  • Computer or network (if online)
  • Financial and health details
  • Interactions with us

We gather information in several ways but most of this personal information is collected directly from you.  In some circumstances we may be legally required to collect personal information (for example to verify your identity) and in other instances providing some information is optional.  There may be circumstances where are unable to assist you if you choose not to provide the personal information requested.

We collect your personal information in order for us to take action requested by you (such as providing Financial Advice) or in order to provide information (such as policy information) or to assist a financial adviser to contact you.

SHARE also collects various information about users of our website.  Our Website Notice gives more detail on how we use cookies and analytic tools on our website.  It forms part of our Privacy Policy, but we have separated it so that it’s easier to find.

Indirect Collection of Personal Information (Information Privacy Principle 3A)

Where SHARE collects personal information about an individual indirectly from third parties, SHARE will take reasonable steps to notify the individual concerned of the collection (unless an exception under the Privacy Act 2020 applies).

This notification will ensure individuals are made aware of:

  • The fact that their personal information has been collected
  • The purpose for which the information has been collected
  • The intended recipients of the information
  • The name and contact details of the agency that collected the information and the agency that holds the information
  • Whether the collection is authorised or required by law (for example, under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, including for Investment or KiwiSaver advice)
  • Their rights to access and request correction of their personal information

This information will be provided as soon as reasonably practicable after collection and will generally be communicated through the Client Information Form, unless the information has already been provided by SHARE or by another agency.

Purpose of collecting personal information

SHARE collects and holds personal information about its clients for the purpose of providing financial advice and related services.

Personal information is stored in SHARE’s client relationship management system. SHARE may also use technology tools, to assist with record-keeping and the preparation of financial advice documentation.

Technology and online tools may also be used to:

  • Obtain quotations and comparisons
  • Undertake research and analysis
  • Apply for identity verification requirements (AML/CFT)
  • Apply for, implement and manage financial products and services
  • Note taking and meeting summaries

To meet its obligations under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, SHARE may be required to verify a client’s identity. This may be carried out using third-party electronic identity verification services, such as AplyID or similar biometric verification platforms. The verification process may involve the collection and use of biometric information (for example, a facial image or liveness check) for the sole purpose of confirming identity.

Biometric information is processed securely by the relevant identity verification provider and is not used by SHARE for any other purpose. Where applicable, this information is collected directly from the client or indirectly via the verification provider, in accordance with the Privacy Act 2020.

Disclosure of information to product providers

SHARE’s financial advisers act as agents of the insurance, KiwiSaver, investment, and lending providers it uses. Accordingly, personal information is collected and shared with these providers to enable them to assess applications, implement financial products, and administer ongoing services, and assess and handle claims and queries where applicable. Referrals to third-party service providers

In some circumstances, and with client permission, SHARE’s financial advisers may refer clients to other businesses where appropriate to help clients access other services.

When someone acts on behalf of a client

Where a person is authorised to act on behalf of a client (for example, under an enduring power of attorney or other legal authority), SHARE may collect personal information from that authorised representative and from third parties they permit us to contact. We consider current legal authorities to fall under the Protection of Personal and Property Rights Act 1988 and therefore collection of personal information from that third party as a direct collection.

Where it is not reasonable or practicable to provide privacy information directly to the client, we may provide that information to the authorised representative instead.

SHARE will rely on the authority of the authorised representative to provide consent for the collection, use, and disclosure of personal information, provided this is within the scope of their legal authority.

Recruitment and employment-related information (including onboarding new Financial Advisers & Authorised Bodies)

When recruiting new employees or engaging new financial advisers, SHARE may collect personal information about an individual from third parties, with the individual’s knowledge and consent.

This may include:

  • Ministry of Justice criminal record checks
  • Credit checks or other background screening relevant to the role
  • This information is collected for purposes related to assessing suitability, regulatory fitness and propriety, and compliance with legal and regulatory obligations.
  • Where personal information is collected indirectly, SHARE will take reasonable steps to ensure the individual is aware of:
  • The fact that the information has been collected
  • The purpose of the collection
  • The source of the information
  • The intended recipients (if any)
  • Their rights to access and request correction of their personal information

Such information will be handled confidentially, used only for recruitment, onboarding or employment-related purposes, and retained in accordance with SHARE’s information retention and security policies and applicable law.

Employee benefits

SHARE provides advice to employers who provide employee benefits to their staff.  This may include the following:

  • Group Insurance: Where SHARE provides advice to employers to provide group insurance cover the direct customer relationship is between SHARE and the employer.  In setting up and administering these benefits SHARE may receive, collect, use, and store employees’ personal information, including, but not limited to, name, date of birth, contact details, and relevant health information. This information may also be shared with the insurance provider chosen by the employer.
  • KiwiSaver: Where SHARE provides advice to employers on KiwiSaver, the direct customer relationship is between SHARE and the employer.  In setting up and administering any KiwiSaver plan for the employer, SHARE may receive, collect, use, and store employees’ personal information, including, but not limited to, name, date of birth, contact details, and income information. This information may also be shared with the KiwiSaver provider chosen by the employer.

It is the employer’s responsibility to inform employees that their personal information will be collected, used, and held by SHARE for employee benefit purposes and be shared with the chosen providers.

Storage, Security and Disposal of your personal information

We are committed to protecting your personal information. SHARE uses cloud-based client relationship management systems, online work management systems and other digital tools, to assist with record keeping, communication, and document preparation. These systems may store and process personal information in secure cloud environments located in New Zealand, Australia and overseas. Where information is stored or accessed offshore, we take reasonable steps to ensure it is protected in accordance with the Privacy Act 2020.

In order to protect the personal information that we gather from you, we have put in place physical, electronic, and managerial procedures to assist in safeguarding and securing the information we collect.

SHARE is required to retain personal information in relation to clients by several New Zealand laws for example the Financial Markets Conduct Act 2013.  We usually hold personal information for at least 7 years although we may keep certain information for longer even if you’re no longer a client.

Disclosing your personal information

You allow SHARE to provide your information to third parties that work with us to deliver financial products, services or communications to you.  SHARE will require those third parties to keep your information confidential and secure.  They may use it only for the purpose that we give it to them for or as permitted by law and in accordance with the Privacy Act 2020, and this Privacy Policy.

SHARE may also disclose information to:

  • The Financial Markets Authority and any other applicable regulatory or government agencies or independent compliance personnel as part of our obligations to meet regulatory and industry standards.
  • Any person or organisation assisting us to investigate any concerns or complaints or manage any legal action; and
  • Any other person or organisation as allowed by applicable law, including the Privacy Act 2020.

Newsletters and other notices

It is our policy to send communications to all SHARE clients to keep you updated with information that we believe is relevant to you. In addition, we may send promotional material to you regarding new or amended material where we think it may be relevant to you.

You can choose not to receive information about our services.  Click unsubscribe at the bottom of the email or you can call us on 0508 274 273, email admin@sharenz.com or tell your SHARE adviser if you don’t want information about other services we offer.

Accessing and Correcting your personal information

The Privacy Act 2020 gives you certain rights to access and correct your personal information.  SHARE will try to ensure that the personal information collected about you is up to date. Please help us by telling us as soon as possible if your information, such as your contact details, changes.

Updates to Privacy Policy

We may change this Privacy Policy at any time and without notice so please review it frequently.  We will take reasonable steps to tell you about changes.  By continuing to use the website, use our services or deal with us in any other way, you agree to the Privacy Policy current at that time.

Breach of Privacy

If we believe that there has been a privacy breach, we will identify the issue and take steps to minimise harm to you.

If we believe the breach has caused, or is likely to cause serious harm, we will contact the Office of the Privacy Commissioner.  We will also contact clients who may be affected by the breach.
